The Supreme Court has made it compulsory to link Pan Card with Aadhaar Card on its verdict on the constitutional validity of Aadhaar. The apex court also stated that Aadhaar is a must to file income tax return and at the same time to for a new PAN.
According to the Central Board of Direct Taxes (CBDT) notification, the deadline to link PAN with Aadhaar has been extended from September 28, 2019 to December 31, 2019. Previously, the deadline to link the same was till September 30 only. From April 1, 2019 it is mandatory to link Aadhaar number while filing Income Tax Return. Here, CA’s have also declared that one cannot file ITR without linking the two first.
The linking of PAN with Aadhaar will hopefully weed out the fake PANs from the system and also ensures to quote the PAN number in financial transactions such as the sale of property or any valuable asset or at the same time depositing large amounts in a bank account.
In addition, section 139AA of the Indian Income Tax Act has also been endorsed by the Supreme Court in Budget 2017. This section has made the quote of the Aadhaar number completely mandatory to apply for a PAN card and for filing income tax returns. In the special cases where a PAN has already been allotted, it is compulsory to link the existing PAN with the current Aadhaar number.
Here, the Supreme Court, in its verdict, systematically evaluated and found some merits in counterfeiting various arguments for linking PAN with Aadhaar.
As we are aware that the last date for linking of Aadhaar card with pan card is Central Board of Direct Taxes (CBDT) notification dated September 28, 2019, the deadline to link PAN with Aadhaar has been extended to Earlier, the deadline to link the same was September 30.
If you do not link your PAN with your Aadhaar, then your PAN will become inoperative from October 1 onwards.
PAN Aadhaar Linking Process:
Now let us know how to link your PAN with Aadhaar.
If you are a registered user at e-filing website:
If you are already filing tax returns, chances are that your PAN is already linked with Aadhaar and it’s quite possible that you have mentioned it previously while filing ITR in the previous assessment years. It is actually done by the income tax department in case details of both are already available with it.
And, to check if your Aadhaar is already linked to your PAN or not simply by visiting the income tax e-filing website www.incometaxindiaefiling.gov.in
Login to the website by entering PAN number (User ID), password and your complete date of birth. Once you done and your account opens then click on -Profile Settings- tab and select the last option -Link Aadhaar-.
Then, the screen will show the message that Your PAN is already linked to Aadhaar number XXXX1234′.
In case your PAN is not linked to Aadhaar then a form will appear where you will be required to enter all the relevant details like – name, date of birth and gender as per PAN records. Subsequently your Aadhaar number. Later simply click on submit after entering the captcha code appearing on the screen.
Once submitted then a success message will be displayed on your screen.
For non- registered users:
If its a case that you don’t want to register yourself at the e-filing website, then there is another way using which you can link your PAN and Aadhaar. You may see that a hyperlink has been provided at the homepage of the e-filing website and also on the income tax website: http://incometaxindia.gov.in/Pages/default.aspx.
Just click on -Link Aadhaar-on the e-filing website. Soon,a new form will appear where you are required to enter details like – PAN, Aadhaar number and Name as per Aadhaar.
If any case if your aadhaar card has only year of birth, then also you must tick the option: -I have only year of birth in Aadhaar card-then, enter the captcha code and click on submit. Once it is submitted successfully, a message shall be displayed on your screen showing that your PAN is successfully linked to Aadhaar.
Other methods
a) By sending an SMS:
If in any case you are unable to link your PAN and Aadhaar using the e-filing website of the department then there are other possibilities too.
You can link your PAN and Aadhaar by sending simply an SMS. Now, kindly note that You can send an SMS to either of the PAN service providers namely- NSDL e-Governance Infrastructure Limited or UTI- Infrastructure Technology and Services Limited (UTIITL).
The format for the same is– UIDPAN<SPACE><12 digit Aadhaar><SPACE><10 digit PAN>
b) Manual linking- filing up a form (Annexure-I):
Here you need to visit a service centre of PAN service provider, NSDL or UTIITSL. There you will be required to fill in the form -Annexure-I’-along with the supporting documents i.e.: copy of PAN card and Aadhaar card.
Unlike other online services, this service is not at all free of charge. An individual is required to pay a prescribed fee allotted for the service.
PAN Aadhaar Penalty:
Now here is a big news, every time you fail to provide your Aadhaar number accurately in documents related to high-value transactions then you may have to shell out Rs 10,000 as penalty for the same.
This penal provision is expected to be applicable from September 1of this year 2019.
How to Link PAN – Aadhaar Offline:
- You have to submit the filled form available i=online and even at the service centres to the authorized PAN Service Centers.
- Kindly note that it is not FREE service. Such designated PAN Service Centers will charge you some paltry amount of Rs 50 or so. However, this charge is not levied by IT Dept.
- Whereas, these authorized PAN Service Centers will not charge you any fee if you are linking Aadhaar with PAN Card actually while applying for new PAN card.
- You have to attempt the Biometric authentication while linking Aadhaar with PAN Card OFFLINE.
- Such Biometric authentication becomes COMPULSORY if there are sufficient mismatches.
- The list of authorized PAN Service Centers is available on the NSDL and UTIITSL portals.
